I read that OK Magazine, who broke the story, is going to pay $1,000,000 for the first pictures of the baby.

The problem, then, is that such calls do not address an opposition audience so much as they signal virtue. They talk past those who need convincing. They ignore actual facts and counterargument. And they are irreparably smug.

It would be rape in Virginia, but not in Maryland (where I originally practiced): in Maryland, the age of consent is 14. Maryland has a 'Romeo and Juliet' rule, which 'exempts' the boy from a rape charge if he is no more than four years older than the girl, and Spears's beau is apparently more than four years older than she is, but since she is over 14, it would not be rape in Maryland.

Unless Texas has changed its law, it would be a sexual assault of a minor, as the "victim" is over 14 years old but younger than 17, and there is more than a three-year difference in age. (It is aggravated if the victim is under 14. Also, marriage is a defense.) It appears that this is a second-degree felony.

That being said, with everything else that this baby is facing in life, jailing the dad is not in its best interest.
