What is your definition of an activist court? Your side won the 2 really big cases in the last little while. Gay Marriage and Obamacare. I ran across a paragraph in a book I am reading on Napa Valley that reminded me of Bob#'s post.
In explanation: Moskowite and Bob White are the 2 person minority on some 5 member county land use board or something. Varrelman is part of the 3-member majority block.

Yes, and it is the one big thing he and I disagree on. I did talk with him about it when I met him in 2012, and we did agree that Roe v. Wade and Doe v. Bolton were, legally and Constitutionally speaking, horrible decisions. And in my view, the same-sex marriage decision was an inevitable consequence of right-to-privacy decisions beginning with the overruling of Bowers v. Hardwick and running through the invalidation of DOMA. That's why the post-DOMA decisions were nearly unanimous in overruling proscriptions of same-sex marriage. It's not particularly coherent because, in my view, Justice Kennedy is unwilling to acknowledge that sexual orientation should be considered a protected class for purposes of Equal Protection analysis. But if you conclude that it is, the decision is easy.
The voting rights decision, though, expressly overruled a Congressional finding on an issue that the Fourteenth Amendment expressly commits to Congress. It's hard to get much more active than that. --Bob
