Your logic in this case is completely screwed; no turn in city traffic during hours where there is traffic on the roads is made under the idyllic conditions you would like to see. All drivers are supposed to proceed with caution, not just the ones making turns. In either direction.

As for the law in the area where this accident took place (which I said at the start was not my area), I said at the start that it was screwed too, because it was based on statistics & not actual circumstances. I say unsafe car (as in "no brakes", as in "winds up driving half on sidewalk") trumps "left turners are statistically at fault". Eventually the law did turn out to agree with this. But the officer at the scene did not, because they didn't bother to examine the scene, just cited statistics.

Lol...yes, and I had to bring it back to me!!! 8)

I'm now waiting...the police report won't be ready for 5 days. Then they "will probably" accept that as proof that it was their insured's fault...but want to give him time to submit a written statement...I think partially because they couldn't even understand him on the phone. The adjuster yesterday said they'll wait up to 2.5 or 3 weeks for that. And they won't look at my car before that. So I'm just waiting. I took pictures with my camera phone at the scene, of my car and his...and took more pictures at home with my camera so they can't do anything shady, like say that the damage happened after the accident or something.

I work in insurance too, just at a small company now...and I know how the recent trend is comparative negligence and I'm not letting it happen to me!!! It is going to be 100% his fault, because it was!!!
Isn't it the truth! Just recently I've had two customers who had accidents and the other party had USAA insurance. Both USAA people were backing up, but USAA refused to accept liability because they said the people they backed into didn't do enough to avoid being hit!! I'm sure State Farm will still subrogate, but it's certainly a hassle for our customer.

That's so bad!

When I worked at (unnamed large insurance company because I'm not sure if this story got out) we had a big issue where the claim adjusters or processors were secretly assigning comparative negligence percentages regardless of fault. It was low numbers, usually 10% or 20%, to the party that was NOT at fault. So it reduced their payments accordingly, and they were never told. It all hit the fan and we had to do an audit of that whole process. So I'm on the lookout for that, that's why I went and got an estimate from my trusted body shop yesterday, so that I had something legit to compare any Geico offer to.

Sorry, Estonut, but your logic is flawed. You forgot to take into account that this could have occurred in a location where our puny laws of physics don't apply and a vehicle miles away can crash into a hapless left turner in the four seconds it takes to execute said turn.

Of course, it could happen here as well. If the brakeless, speeding scofflaw happened to be going 1500 mph. Or brakeless speeding scofflaw's vehicle happened to be the Concorde.

Shame on you for not considering all possibilities! You may turn in your nitpicker's union card at the door.
