I guess what it boils down to for me is will I get left with an unfulfilled contract on my XM subscription?

You'd only wind up with a unfulfilled contract if they went under. Not happening - yet.

Just thought I'd bring this forward to answer my own question--if they declare Chapter 11--reorganization vice liquidation--they can and almost certainly will void the contracts of both Stern and their other big money "talent"...Martha Stewart. Stern is unlikely to stay since the stock he also got for signing is now almost totally worthless.

You're assuming he hasn't sold a bunch already. No idea if he had any trading constraints on it, as you would have as a corporate officer or with certain stock options.
