Why is it a civil case and not criminal?

Why are we now hearing about it when it happened in 2004?

The local news said last night that Cuban's attorneys and the SEC have been in negotiation for several years now. Filing the civil suit seems to be a "negotiation ploy".

Insider trading is definitely a crime. Just ask Martha Stewart.

Martha Stewart wasn't convicted for Insider Trading. She was convicted for lying to the FBI.
