Actually, there is a case pending in the Fifth Circuit (which is very conservative) questioning the constitutionality of the statute under which Biden was convicted. His attorney will undoubtedly raise that issue on appeal.
In a 2023 case, the Fifth Circuit ruled that the law banning firearm ownership for illegal drug users violated the Second Amendment. The defendant in that case was pulled over at a traffic stop and they found a rifle and marijuana butts in his car. He admitted to using marijuana, which is considered an illegal drug under this law. That case is only binding law in the Fifth Circuit (MS, LA, and TX) unless another Circuit adopts that reasoning or the Supreme Court issues a decision on the issue. If the Third Circuit (which includes Delaware) adopts the same reasoning, it would follow that asking about drug use on a permit application would also be banned under the Second Amendment.
