More bad news for Republican attempts to rig the 2026 elections. A federal court in Texas has ruled that the state's recent Congressional redistricting was an illegal racial gerrymander and prohibited the use of the new districts in the 2026 elections. Texas has the earliest candidate qualifying deadline and the earliest primary in the nation. Qualifying is going on now, and the deadline is December 8. The state has already said it will appeal to the Supreme Court. It's possible the Supreme Court could issue a stay of the lower court's ruling between now and December 8. The opinion was written by a Trump appointee.

This decision does not affect California's recent redistricting or those in any other state. Republicans in California have filed a suit challenging that redistricting, but that case is at a much earlier stage, since the California redistricting did not take affect until after this November's election.

Justice Alito has issued a stay of the lower court decision upon Texas's appeal. The application went to him because he is the justice who oversees appeals of this nature arising in the Fifth Circuit. The plaintiffs will have until Monday to file a response, at which time the entire Court will decide whether to continue the stay until they can hear the entire case on the merits. If the Court does issue the stay, it means that the new Texas districts will remain in effect for the 2026 election.

The full Supreme Court granted the stay in the Texas gerrymandering case pending the results of a full appeal, meaning that the 2025 map will stay in place for the 2026 election. The 6-3 decision (the three liberal justices dissenting) was unsigned. It's also highly unlikely that the California map and any others enacted before the 2026 elections will be overturned before the elections, so various states have free rein to redistrict as they please for 2026.

Subsequently, a New Jersey court similarly ruled this week that Trump's appointment of Alina Habba as acting US attorney in New Jersey was illegal. That calls into question any indictments Habba's office obtained during her tenure.

Today, the grand jury in Virginia refused to re-indict Letititia James in a case brought by different prosecutors. The status of any future prosecution against Comey is uncertain.

Let's put this in terms you might be able to understand. The indictment in this case, which was thrown out because the US attorney was illegally appointed, was for alleged mortgage fraud on her part. Two subsequent grand juries in two different Virginia counties refused to indict her on that same charge.

No one has ever charged her for an alleged malicious prosecution of Trump.

The US Attorney was appointed in the only way she could because of legal fucking games your party plays. They are forcing Trump to appoint leftist attorneys or he gets no appointment at all. And RINOs go along with it. How she got appointed really had no bearing on the indictment. It happened. But your party found a Clinton appointed judge from South Carolina to sabotage the case and get it ignored. The Judicial System in this country is so out of control it is a disgrace. Federal Judges think they are the Kings and Queens. I thought your minions had a big protest against kings.

The US Attorney was appointed in the only way she could because of legal fucking games your party plays.

As usual, you're about 99% wrong. (I'm giving you the benefit of the doubt here.) There was a validly appointed (by Trump) and confirmed US attorney in Virginia, Erik Siebert. Despit what you and Trump may think, prosecuting attorneys are not a President's hired legal guns, charged with securing prosecutions against his political enemies. They are bound by ethical rules that prohibit them say they must "refrain from prosecuting a charge that the prosecutor knows is not supported by probable cause." That's the reason that Siebert and his staff would not go after indictments of Comey and James. Trump forced Siebert to resign instead of being fired.

Trump then did not attempt to place Halligan's name in nomination for the vacancy, where she may or may not have been approved by the Senate. Instead, he and Pam Bondi appointed her contrary to what the law requires. You are correct that there is an informal "blue slip" rule whereby a state's senators can block an appointment of a judge or US attorney in that state. However, that's a tradition, not a rule, and the Senate (controlled by Republicans) could abolish that tradition by rule. However, the Senate under Trump now and in his first term chose not to do so when they were in the majority. Further, the Senate could have confirmed the choice without getting the approval of the Va senators. (17 judges were confirmed in Trump's first term without getting blue slip approval.) But Trump did not go the legal route.

Of course, I have no idea how many of the Senators who don't want to do what Trump wanted here are RINO's. Which brings me to another definition for the Flock dictionary:

Republican in Name Only (RINO) - Any Republican who won't do exactly what Trump wants, whenever he wants.

And for what it's worth, because the judge ruled against Trump because Halligan's appointment was illegal, it didn't reach the merits of the motions to dismiss Comey and James filed. Considering that two other grand juries failed to indict James, there's a pretty good chance the indictment would have been thrown out on those grounds as well. (Any attempted re-indictment of Comey would now be barred by the statute of limitations.)
