The Supreme Court has ruled in the 2003 case of Virginia v. Black that a state (and by extension, the US) could prohibit "true threats" (as opposed to statements that were jest or hyperbole, like "I'm going to kill him if he shows up late") if the speaker "means to communicate a serious expression of an intent to commit an act of unlawful violence to a particular individual or group of individuals." The more recent case of Counterman v. Colorado in 2023 said the government must show that he speaker understood the threatening nature of his comments.

The prevalence of "86" comments in regard to politicians, not to mention the vast number of tee shirts and other paraphernalia with "86 46" and "86 47" slogans negates the idea that these comments constitute a serious threat of danger, so neither Comey nor Posobeic, whose cases are objectively identical, nor any of the tee shirt manufacturers or the people who wear the tee shirts, is guilty under anti-threat statues. For the same reason, no one who says "F*** Trump" or "F*** Biden" is guilty of making a threat to forcibly rape either person.
