I'm sure the defendant appreciated the juror getting himself kicked off the jury so the guilty verdict could be rubber stamped by an alternate, instead of hanging in against the other 11 jurors to prevent a guilty verdict.

Well, that would just have resulted in another trial.
Not sure how this will play out in the Federal Courts, but I'm pretty sure that in Texas State courts, the Judge removing a Juror under these circumstances would result in a reversal and the order of a New Trial.

Very interesting. I'm also glad to see that Indiana is one of those states where jury nullification is clearly spelled out as a possibility in jury trials.
And the man's argument is classic Libertarianism (Capital intended). I'm not real comfortable with the national party's stance on across-the-board legalization of all drugs, so I can't say I would've done what he did. But I can admire it.
