Question for lawyer sorts

Regarding Helene flood damage. Do you think there will be class action lawsuits against insur cos because the proximate cause of devastation was wind storm, covered under policies? I was a claim adjuster way back and could see this.

What would be the reason things wouldn't be covered. I don’t understand the question. It was a named storm so anything but flood damage would be covered like it is in Houston. Flood damage separate

I wouldn't expect a class action because the underlying facts relevant to coverage may well be specific to each individual loss. But I would expect a load of individual lawsuits if the carrier takes an aggressive position on coverage. --Bob

Flood damage can happen without wind. Massive rains, etc.

Right, but flood and all other hazard are usually separated, regardless of root cause (storm, wind, fire, hurricane, earthquake, etc.) Flood damage is not usually covered by any home owner policy. It's a separate policy through the National Flood Insurance Program. Though you might be able to buy private flood insurance, it will be a separate policy from the regular home policy.

I know. We bought it for like two years and cancelled. Just was curious if things will be re interpreted.
