And guess what?

Because of NY bail 'reform' laws, this guy was RELEASED and is back on the street. I guess it's in the hope he'll get it right next time.
Please explain to me what would have happened if this was the Democrat Candidate for Gov. Or any dem candidate.

OK, lefties. Nothing to see here. Let me have it with your justifications and explanations.

Statement from President Biden:
I condemn the attack on Congressman Zeldin in the strongest terms,' Biden wrote in a statement. 'As I've said before violence has absolutely no place in our society or our politics. I am especially grateful for the courage of those who immediately intervened, and that he is unharmed and was able to continue his speech. I also want to thank the law enforcement officers who quickly took action and are investigating this attack that defies our fundamental democratic values.
The defendant was an Iraq war vet who appeared to be drunk. He was charged with attempted assault in the second degree. I'm not an expert on New York criminal law, but that seems to be about as mild a charge as you're going to get. I've seen the video and it wasn't a very violent attack. If you're going to blame somebody, blame the police who decided how to charge him with not filing more serious charges.

They let the police decide what charges to bring in New York? All the L&O epsisods, and Blue Bloods, has the DA's office deciding.

I've seen the video. No matter how incompetent the attack or how drunk the guy may have been, the bottom line is that he attacked a candidate for Governor of New York with a deadly weapon. It strikes me as troubling if he was released on his own recognizance. I'd like to know more about what went into that decision. --Bob

It is the law crafted and implemented by the democrat machine that runs NY.

Better watch your back. Showing some semblance of common sense is not well looked upon in your party's narrative, however rare it is.

This comes from the New York State Office of Mental Health website (I don't know why they would have this but they did):
The criminal justice process begins when a person is arrested. A police officer may apprehend and take into custody a person who commits a violation, misdemeanor of felony in the police officer’s presence. New York law also allows a police officer to make an arrest for a felony not committed in his or her sight and without a warrant whenever the officer has “reasonable grounds” to believe that a felony has been committed and that the defendant is the person who has committed the crime. Once an arrest has been made, the accused is brought by the arresting officer to a booking facility. Outside New York City, the booking facility may be a local police station in the case of cities, a town or village police station, a state police barracks, or a county sheriff’s office, depending upon where the arrest occurred and which law enforcement agency made the arrest.

On a charge of misdemeanor or violation, a local police department, pursuant to guidelines, has the authority to release an accused either before or immediately after booking. The accused may be required to post pre-arraignment bail (also known as station house bail) to secure later court appearance. Such an accused is given an Appearance Ticket (also known in New York City as a Desk Appearance Ticket or DAT). Unless released on an Appearance Ticket, the accused is brought to a local criminal court by the arresting officer at the completion of the booking process. As a safeguard against illegal detention in jail, the law requires that the arrested person be promptly arraigned before a judge.

The criminal complaint serves as the basis for the commencement of criminal proceedings and is prepared by the arresting officer or by the complainant (i.e., victim of the alleged crime) and filed with a local criminal court which accuses one or more persons with the commission of an offense. In New York City, the arresting officer escorts the accused to the court building after the booking process is completed. There, the officer and/or the complaining witness (victim) speak to an Assistant District Attorney from the District Attorney’s office. The Assistant District Attorney decides whether it is appropriate to send the case to court. If so, a formal complaint against the accused is filed in a local criminal court by the District Attorney’s office on behalf of the People of the State of New York. This written document must be processed along with the defendant’s criminal history (called a NYSID report or “rap sheet”) before the defendant can be arraigned. Outside New York City, the District Attorney is not an integral part of this process and the arresting officer and/or complaining witness (victim) may prepare and file the complaint directly with the local criminal court. The District Attorney receives a copy of the formal complaint, usually at arraignment.
So, in New York City, the DA's office gets involved in the process much quicker than in other counties. And the police department has the authority to release the accused at booking pending arraignment.

This happened in Rochester. So it appears that it was the Police Department's decision. --Bob

Here is a picture of the weapon the attacker was carrying when he confronted Congressman Zeldin. It sells for $10 online. It does put the charges filed in a somewhat fuller context.

Also, the local district attorney, whose office declined to charge Zeldin with a felony that would have resulted in him being held until posting bail, is the co-chairman of Zeldin's election campaign.

Some of the left-wing sites are saying that this attack was staged to prop up a floundering campaign and support some standard Republican campaign issues. If you've seen the video, this attack didn't appear to be very vicious in nature. The attacker had posted on his website that he was desperate to get work of any kind.

Nobody has mentioned the attacker's name, and I won't either so as not to glorify him. I'll just point out that it isn't Zeldin.

I wonder what the troller thinks Zeldin should have been charged with. Depriving his attacker of his first amendment right to 'peaceful' protest?

No, it's a typo. I meant to say "Zeldin's attacker" but it didn't come out right.
