The current Court is the most activist of my professional life. It's moving the law in a way that I really don't care for, and that I largely think is results-driven rather than driven by principled reasoning. A Republican President and a Republican Senate will likely solidify that tendency for the rest of my professional life. --Bob

What is your definition of an activist court? Your side won the 2 really big cases in the last little while. Gay Marriage and Obamacare. Yes, and it is the one big thing he and I disagree on. I did talk with him about it when I met him in 2012, and we did agree that Roe v. Wade and Doe v. Bolton were, legally and Constitutionally speaking, horrible decisions. A decision that is logically incoherent, particularly when it overrides the political branches.
