It was a federal trial so there will be fewer layers of appeals. --Bob

But there hasn't been a Federal execution since 2003. Only 3, since the death penalty was reinstated in '94, all this century, one being Tim McVeigh.

Friend if mine is an FBI analyst who worked on the case. There is no question he knew he was leaving the bomb next to a kid. What else do you need to know.

From reading Vandal's article, it appears that the defense attorneys found Twitter posts from a couple of the jurors indicating that may have formed an opinion about Tsarneav's guilt before the trial. (One post from the person who eventually became the jury foreperson referred to him as a piece of garbage.) The appeals court felt that the trial court should at least have made further inquiries of the two jurors before allowing them on the jury.

It's interesting that the appeals court did not overturn the guilty verdict itself, only the death sentence. I'm puzzled by that, because if the jurors were prejudiced, it would seem that such prejudice would extend to the guilty verdict itself.

I'm really glad that Colorado eliminated the death penalty. There's a local case which would have put heavy pressure on the DA to seek the death penalty, which if it happened would make me ineligible to serve on the jury.

I probably won't be eligible to serve anyway. I'm sure the defendant is guilty, along with probably 99% of other local residents. How the defense didn't get a change of venue is beyond me. In the unlikely event I'm called with the estimated 600 potential jurors, I'll bet I never make the jury box.

Strange you should mention squirrels. I haven't seen one since this spring. Chipmunks, on the other hand, keep zooming across the path about 10 or 15 feet ahead of us. I'm not complaining, I hasten to add. The chipmunks aren't mangy . . .

AND, with their singing voices, they make for great Bee Gees cover bands.
