The article mentions that the kids have learning disabilities. In our district the kids with disabilities have IEPs. If they have IEPs they are pretty much immune from punishment.

You can punish within the context of an IEP.
I even oversaw suspensions of kids with IEPs.

All of my sisters students have IEPs. Many have been punished in many ways. Some have been expelled.

I had to read up on IEP's, but I don't see where discipline is addressed anywhere. Maybe I just looked in the wrong places.

I had students with IEPs. Some IEPs dealt with punishments but mostly they were instructional guidelines. Kids that could have someone read a test out loud or not have any time limits, that kind of thing. Every single special ed, ESL, and handicapped student had one.
The tricky part of IEP students and punishments is that usually it means you have to have committee meetings that include the child's guardians and sometimes state-appointed representatives. So, in fact, punishments were much less often given to students with IEPs just because it was a big hassle. I was part of IEP conferences, though, that expelled, suspended, and transfered students. It can be done.
