My bet is that he will get overturned. There is nothing on the face of "moment of silence" that would violate the 1st Amendment or even run afoul of the silly "Lemon Test"

As long as there are math tests, there will always be prayer in school.

I can't speak for other states, but in Indiana it was a very transparent attempt by the people who think school mandated prayer was a good thing to sneak prayer back in the schools by the back door. Why some Christians think it is so important to force others to indulge in their religious traditions that they would employ sneaky, underhanded tactics is beyond me, but oh well.

As for the Moment of Silence, I don't find it unconstitutional per se, just silly and unproductive.

Not for the teachers, for whom it is the last moment of quiet they get before the day's chaos starts.

Most teachers would prefer about eight hours of silence a day in public schools.
