The brakeless driver who hit the people I know was driving in an undisclosed-to-you midwestern city, not Boston. Lets just say its midwestern enough for the hitter to have taken them by surprise. Hitter was also driving half-on-sidewalk while trying to make a right turn into same driveway as the people they hit, which is illegal in any locale (even Boston, though that doesn't stop 'em here).

Re-hijacking the thread. What the HELL does that mean? (Having grown up in and lived in some midwestern cities, as opposed to all the other cities, left and right coast, that I've lived in where the likelihood of weird drivers would be greater.)

I can give a good example of Midwestern vs. Bostonian driving. I spent some time at a big midwestern university. Many intersections in the area were 4-way stop signs, which are virtually non-existent in the Boston area. To my amazement, drivers stopped at these intersections behave as if they took numbers to go through - one car at a time, and each in the order of when they reached the stop sign.

I returned to Boston, having absorbed some of this politeness. Reached an intersection near downtown where my side and the opposite side had stop signs. Car on the opposite side reached the intersection slightly before I did, planning on taking the left turn in front of me. The through street perpendicular to us was clear. The other driver was clearly waiting for me to jump through the stop sign. I waved her on ahead of me, since she had reached the intersection first. Her look of amazement as she passed by was worth it.

I actually tried a case last year where the Defendant Big Trucking company said it was not at fault for turning left in front of my defendant Little Trucking Co. because my client could have stopped and avoided the accident. The jury disagreed to the tune of 5.5 million dollars. (I was defending the truck with the right of way who went left of center to avoid the turning truck)

I can attest to the fact that there are many people in my Midwestern city who have no clue how a four way stop works. I have wasted countless hours over the years sitting at stop sign waiting for drivers who were at the intersection way before me to take their turn. Apparently, there are a lot of people who think "Stop" means "wait until everyone within 30 feet of the intersection has cleared the area before proceeding". And of course, there are also plenty of turn jumpers, especially at a 5 way stop near where I live where it is possible for turn jumpers to make it through the intersection before getting hit... especially if they don't come to a complete stop.....

Oh, don't get me started on that. There is beaucoup big truck traffic around here due to all the industry, and that is exactly how many of those big truckers think..... "I will make my turn when I feel like it and you will hit the brakes or else get yourself creamed". I had to slam on the brakes at 50 mph one time to avoid hitting the broad side of a semi that decided to make an illegal left turn (There was a left turn signal at the light, not a left turn yield) not too far in front of me....

I've heard that story a hundred times.....I turned left sure, but the other car could have
stopped, but didn't..and they hit me!! You mean that's not a defense?!?!?
