Interesting article, Bob. In practical terms, if Congress thinks Trump business dealings violate the Emoluments Clause, they can write legislation, and if he vetoes or disobeys it, they can take him to court or impeach him. I doubt the courts will act on their own to enforce the clause.
I don't think that Congress has to write legislation. I think they can skip right to impeachment.
I agree that standing to enforce the Emoluments Clause in a federal lawsuit would be challenging. I'm still giving thought to how to overcome that hurdle. --Bob

OK, so anyone who runs a business is disqualified from being President. That's what you're saying. You can find stuff like this on anyone who runs a business. OK. Let's make it a law that only lawyers and professional politicians can have the job. Why stop there? Make it a law that only democrats can be President. Or how about anyone who George Soros picks? Anyone else is illegitimate.
So you're okay with the President accepting bribes from foreign governments, as long as he's careful to use his businesses to launder them rather than accepting them directly.

At least, Trump picked up one new supporter over the weekend. I understand Rob Schneider has been added to the entertainment list for the inauguration. For most people, a similar brouhaha over insulting John Lewis would be the absolute low point of an actor's career, but in Rob Schneider's case, he has so many career debacles that it's hard to definitively single this mess out as the worst thing he's ever done professionally.

If they're fed up with Trump and looking for an excuse to impeach him, the Emoluments Clause would work. If they just want him to change his business dealings, legislation or a court case, backed by the threat of impeachment, is more effective.

Why does he need to accept bribes? He seems to have all the money he needs. He is not even accepting a salary. That seems to take that motive off the list. You seem to have your panties in a wad about Trump. What are your motives, and why are they assumed to be pure white?

Why? He could bribe other countries with his own money if he wants. I don't think he needs more money. I would think it would be pretty stupid to try and get a few more bucks by taking bribes. That is one of the advantages of having a lot of billionaires on the cabinet. But logic isn't the issue here is it? It seems like the idea is to fabricate some issue to get him impeached. My memory isn't what it used to be, but isn't that what the dems were so upset about when they falsely accused repubs of doing that against Pres. Obama? Doesn't make a particle of difference. The Constitution doesn't say that people who don't need bribes are entitled to accept emoluments. It
does say that Congress can expressly approve them. So if draft-dodging Donald wants to get Congressional approval for his business dealings, he's free to do so. Until and unless he does (and I'll be astonished if it happens), he's in violation of the Constitution. --Bob

Prisons are filled with people who didn't need more money but nonetheless continued to steal or otherwise break the law until they got caught. And, yes, you could say they were stupid. Most people in prison are stupid.
