For those who may be interested, here is the Ninth Circuit's opinion affirming the conviction of Barry Bonds for obstruction of justice. --Bob

The en banc panel of the Ninth Circuit reversed Bonds's conviction in a 10-1 vote. There was, however, no majority rationale for the decision. --Bob

feels he represents the many educated and rational onlookers who believe that the hysterical denouncement of lay scepticism is both unwarranted and counter-productive
The problem, then, is that such calls do not address an opposition audience so much as they signal virtue. They talk past those who need convincing. They ignore actual facts and counterargument. And they are irreparably smug.

It's over. The Department of Justice has announced that it will not seek review of the Ninth Circuit 's decision from the Supreme Court. --Bob
