1. They are not prohibited. In fact, I think one has already become a regular contestant.
2. A producer (or two) walks up to someone in the audience and asks them whether they want to be a potential one question contestant. If yes, they're handed an application/disclosure packet. It's on yellow paper.
I was at the final tapings of the season on November 19, so I got a preview of the Wii game prize. The one Meredith uses on the set is a prop. I was hoping to be the first person to become a one question contestant after being a regular contestant - it was close, but no cigar. Someone very near to where I was sitting became a one question contestant, which is how I learned about the process.
